Agreement:

You “User” are entering into a subscription agreement “Agreement” by American Building Structures “ABS” to use our website. User agrees and acknowledges that the following Terms and Conditions as well as the Privacy Statement are acceptable and agreed to. The User further agrees and acknowledges that this Agreement shall be the governing body for the use of our website for information access. From time to time, ABS may be required to update, modify and revise this Agreement and reserves the right to do so at any time and with the complete understanding and acceptance of the User.

ABS reserves all rights afforded by the state of Colorado, and of the United States. ABS also reserves its rights, claims and defenses for any omission from the contents of this Notice and Agreement to the User of the ABS website.

ABS reserves the right to limit and modify the number of postings, subscribers, information and other content by its own consent and discretion.

ABS reserves the right to evaluate its subscribers and postings for authenticity however will not be held liable in any manner or form for improper listings.  ABS must work on a best efforts basis that all subscribers and postings are legitimate and are entering into this agreement with full professional and proper understanding and consent.

User agrees and acknowledges that ABS will post their approved construction project quote request on their sister site; nationalconstructionzone.com. The purpose for posting the User’s construction project on the sister site is to allow: General Contractors, Sub & Specialty Contractors, Manufacturers, Suppliers, Architects, Engineers and Construction Services and others to access and review, bid, contact and discuss your project in more detail.

Subscription Fees and Other Charges:

ABS does not charge Fees or Other Charges for the use of their website.  ABS’s website and its services are provided at “No” cost to the user/subscriber.  This website is developed in order to help and assist our User’s/subscriber’s to list and post their construction project needs and requirements.

Length of Time Listing is Posted:

User’s construction projects will be posted for 90 days “Active” and will then be archived for reference and history.  Should a User require more time for their construction project to be “Active” the User may “update” which will add another 90 days of posting.

Cancellation:

User may cancel their subscription at any time by email only.  Simply click "Contact Us" and send us a message that you wish to cancel.  We will immediately respond to all messages and requests.  ABS will confirm any such cancellation by User via email using the registered email address designated by the User on their member profile. ABS does NOT accept cancellation by any other means. Your cancellation will be effective within 2 business days of your request.

ABS may cancel a User’s subscription at anytime and without notice due to the User’s breach of this agreement.

Use of “americanbuildingstructures.com”:

The use of this site is solely for the purpose of posting construction projects that are requesting quotes, information and/or construction products and services by and for the User. User agrees and acknowledges that their use will be limited only to these areas.  ABS has the right to review any and all construction project quote requests for content. ABS also has the right to refuse any construction project posting should they feel that it may violate this agreement. This site shall not be used for competitive, fraudulent and illegal purposes. The information obtained and contained within the ABS website may not be used for redistribution or any other purpose contrary to its purpose. User may not use the ABS website in which the security is/may be compromised. The User agrees and acknowledges not to gain improper or illegal entry nor submit into the ABS website any electronic messages, emails, links, viruses, spams, etc. that may harm the ABS website, our affiliates and clients that may cause damage to equipment and systems. Any such violations will be punishable by law and in accordance to the laws of the state of Colorado and the United States of America.

User agrees and acknowledges that their use to the ABS website, the information and other services provided by ABS and through their website are at the sole risk of the subscriber.  ABS is not liable for any direct, indirect , punitive damages or any other losses occurred by the User from accessing the ABS website.

Intellectual Property:

User agrees and acknowledges that all information posted, listed and shown on the ABS website is the sole intellectual property of ABS.  No duplication, reproduction, transferring and any other use without the written consent of management is strictly prohibited.

Warranty:

ABS makes every reasonable effort to ensure that all content is current and correct. However, ABS can not be held liable for any misinformation that a posting client or subscriber may submit. ABS must rely on the professionalism and truthfulness of its Users. Therefore, ABS does not and will not guarantee or warranty any information, services, quotes, bids, products or any other source on its websites. Any quote, information, product or service is at the User’s discretion. ABS strongly urges Users to use all reasonable efforts to request referrals, references and other forms of due diligence to verify the quality, warranty, insurance, bonding and other important issues that are associated with construction, products and services. User agrees and acknowledges that ABS does not provide any warranty nor implies that there is one. All information and its content provided by the ABS website and its management is on an “As Is” basis and without warranty or liability.

Limitation of Liability:

ABS in no such and agreeable terms shall be held liable in any manner for the loss of profits, business, data, accidental, incidental and punitive damages.

ABS Indemnification:

User agrees and acknowledges to indemnify ABS, it’s parent company, it’s sister company, employees, its officers and affiliates against any declared claims or suits made by any third party for any damages, breach of contracts, content, data, losses or any other type of loss by the User resulting from the use of ABS website, its employees, its officers and affiliates.

Unlawful Conduct:

User agrees and acknowledges not to use and to act professionally and respectfully when using the ABS website. Any transmittal of illegal, profanity, vulgarism, viruses, spams and other.

Inappropriate content, links, videos, attachments, etc. is strictly forbidden and enforced. Any such attempt or conduct is punishable by the laws of the state of Colorado and the laws of the United States of America.

User agrees and acknowledges that ABS may at any time review and monitor users and clients transmissions and other communication related to the website.

Website Links:

From time to time ABS may provide links, videos and other forms of electronic media. User agrees and acknowledges that the user will not hold ABS liable for such material. All third party forms of transmissions, links, videos, etc. are done for the benefit of users and are by no means approved, endorsed or implied to be guaranteed or accredited.  All information obtained is on an as is basis and at the sole discretion of the user to perform all proper due diligence before making any decisions.

Terms and Condition Notes:

This agreement is the entire and only agreement and supersedes all other agreements whether written, oral or implied.
